Acceptance of Terms

You accept and agree to the terms set out below by using preceptbible.com or The Precept Bible mobile application on any platform where it is available. Please read our Terms and the Privacy Policy carefully before you start to use The Precept Bible. If you do not agree to these Terms or have an issue with the Privacy Policy, please do not access or use The Precept Bible.

Changes to the Terms

The Precept Bible is offered by Prolificat Limited (“Prolificat”, “we” or “us”), and at our sole discretion we may revise and update these Terms occasionally. You will be informed of any changes if you are subscribed to our mailing list, however any changes are effective immediately when posted. You accept an agree to these terms if you continue to use The Precept Bible.

Changes to The Precept Bible

The precepts in, and features of The Precept Bible mobile application and the web version of the Precept Bible are created and maintained by Prolificat, and we reserve the right to change or cease offering any of these precepts or features. The bible version used is based on the 1611 King James Authorised version with Apocrypha, and the contents of the bible itself will never be changed. We will not be liable if for any reason The Precept Bible is unavailable at any time. Changes may be effected on the web versions ahead of or separate from the mobile application.

Your Information

All the information we collect about you on or through The Precept Bible is subject to our Privacy Policy. By using The Precept Bible, you consent to all actions taken by us with respect to your information in compliance with our Privacy Policy.

Permissions for Use

You are only allowed to use The Precept Bible in accordance with these Terms for your personal and non-commercial use, or for use of your non-profit organization. All rights are reserved by Prolificat Limited except those expressly granted you. You agree you are not permitted and will not use The Precept Bible as follows:

• In any way that violates local or international law or regulation;
• For the purpose of attempting to or exploiting or harming other individuals in any way;
• To request or collate personally identifiable information from others towards any attempt of malpractice or harm;
• To impersonate or attempt to impersonate any company or person including Prolificat Limited;
• To expose minors to inappropriate or indecent content;
• To engage in any conduct that we deem harmful to yourself or others, or that may expose them or us to liability;
• In any manner that could disable, overburden, damage or impair The Precept Bible, or interfere with others’ use of the applications;
• To introduce any digitally malicious content such as viruses, Trojan horses, injection attacks, spam, or any other malware;
• To monitor or spy on any company or persons using any means like robots, crawlers, automatic processes or other such devices;
• To plagiarise or copy The Precept Bible, it’s content or code;
• To attempt to or gain unauthorised access to interfere with, corrupt or disrupt service of any parts of The Precept Bible on any server, database or connected device;
• To perform malicious or unauthorised actions such as denial-of-service attack, distributed denial-of-service attack, load testing, hacking;
• Otherwise in any attempt to interfere with the proper working of The Precept Bible.

You also agree that you will not send, knowingly receive, upload, download, use or re-use any material which, as determined by Prolificat in it’s sole discretion:

• Contains any material which is defamatory, obscene, indecent, abusive, harassing, inflammatory, deceptive or otherwise objectionable;
• Infringes any patent, trademark, trade secret, copyright, or other intellectual property or other rights of any other person or company;
• Violates the legal rights of others or contain any material that could give rise to any criminal liability under applicable laws or regulations;
• Impersonates or falsely represents Prolificat Limited in any way;
• Promotes or endorses any unlawful or illegal acts;
• Involves commercial activities such as sales, contests, gambling, or other advertising that is not produced by Prolificat or its direct affiliates.

Content From Users

The Precept Bible may at any time allow user generated content such as comments or posts, which other users would be able to view. While we will make every effort to moderate these user contributions to align with our terms, we cannot ensure prompt removal of objectionable material after it has been posted. We therefore assume no liability for any action or inaction regarding transmissions, communications or content provided by any user or third party. We ask that all user contributions comply with these Terms. By providing any User Content on or through The Precept Bible apps, you grant us and our service providers, and each of our respective licensees, successors and assigns, the right to use, reproduce, modify, perform, display, distribute, delete, and otherwise disclose to third parties, law enforcement or regulators, any such material as we deem necessary for compliance or product enhancement or analytics purposes. We are not responsible for, or liable to any third party, for the content or accuracy of any user contribution generated by any user of The Precept bible.

Personal Information

The Precept Bible will only ever ask for necessary contact information such as email or names for clearly stated purposes such as newsletters and user generated content. By providing your information through The Precept Bible, you agree that Prolificat has the right to use it for the agreed purpose only, and in line with our Privacy Policy.

Intellectual Property Rights and Infringements

The Precept Bible and its precepts, contents (apart from those publicly available), features and functionality (including but not limited to all information, software, text, displays, images, video and audio, icons, logos, and the design, selection and arrangement of same) are owned by Prolificat Limited, its licensors or other providers of such material, and are protected by the United Kingdom and international copyright, trademark, patent, trade secret and other intellectual property or proprietary rights laws. You must not use these marks and copyright without the prior written permission of Prolificat Limited. All other names, logos, product and service names, designs and slogans on the Precept Bible are trademarks of their respective owners. If you believe that any content of The Precept Bible, including user generated content, infringes on your intellectual property rights, including copyright, please send a notice of copyright infringement to support@prolificat.com with as much detail as necessary.

Legal Compliance and Enforcement

You agree that we have the right to:

• Take any action with respect to any user or user contribution that we deem necessary or appropriate in our sole discretion if we believe there to be a violation of these Terms, infringement of third party rights, a threat or liability or harm to persons or the goodwill associated with The Precept Bible or Prolificat Limited;
• Take appropriate action, including but not limited to, referral to law enforcement and disclosure of personal information, for any illegal or unauthorized use of The Precept Bible;
• Terminate or suspend access to all or part of The Precept Bible for reasons that may be communicated to you only at our sole discretion, including but not limited to the violation of these Terms.

Without limiting the foregoing, we have the right to fully cooperate with any law enforcement authorities or court order requesting or directing us to disclose the identity or other information of anyone posting any materials on or through The Precept Bible. YOU WAIVE AND HOLD HARMLESS PROLIFICAT LIMITED AND ITS LICENSEES AND SERVICE PROVIDERS AND ALL OF THEIR EMPLOYEES, OFFICERS AND DIRECTORS FROM ANY CLAIMS RESULTING FROM ANY ACTION TAKEN BY ANY OF THE FOREGOING PARTIES DURING OR AS A RESULT OF LEGAL INVESTIGATIONS AND FROM ANY ACTIONS TAKEN AS A CONSEQUENCE OF INVESTIGATIONS BY EITHER PROLIFICAT OR LAW ENFORCEMENT AUTHORITIES.

Third Party Links and Services

The Precept Bible may include content provided by third parties. Such content as links, widgets and similar resources provided by third parties are for your convenience only. We have no control over the sites linked or resources provided, and accept no responsibility for them or for any loss or damage that may arise from your use of them. By using these links and resources, you agree to the terms and conditions of such websites and third parties. We are not responsible, or liable to you or any third party for statements or opinions expressed, or content held by the provided resources of those third parties.

Indemnification

You agree to defend, indemnify and hold harmless Prolificat Limited, its affiliates, licensors and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses or fees (including reasonable attorneys’ fees) arising out of or relating to your violation of these Terms or your use of The Precept Bible, including, but not limited to, your User Contributions, any use of content from The Precept Bible, services and products other than as expressly authorized in these Terms or your use of any information obtained from The Precept Bible.

Entire Agreement

These Terms and our Privacy Policy constitute the sole and entire agreement between you and Prolificat Limited with respect to The Precept Bible and supersede all prior and contemporaneous understandings, agreements, representations and warranties, both written and oral, with respect to The Precept Bible.

All feedback, requests, comments or concerns, and any other communications relating to these terms and Prolificat Limited or The Precept Bible should be directed via email to support@prolificat.com or through the website http://prolificat.com/#contact and as such will be deemed non-confidential.
